Terms and Conditions for Digital Product Download

Effective Date: April 17, 2025

Welcome to Nested, LLC ("Company," "we," "us," or "our"). By downloading and using our digital product(s) and printed product(s) (the "Product"), you agree to be bound by these Terms and Conditions (the "Terms"). Please read them carefully before completing your purchase or download.

1. Acceptance of Terms

By downloading or using the Product, you agree to these Terms and our Privacy Policy. If you do not agree with these Terms, do not proceed with the download and/or do not proceed with printing the Product.

2. License Grant

Subject to your compliance with these Terms, Nested, LLC grants you a non-exclusive, non-transferable, revocable license to download, install, and use the Product for personal, non-commercial use. You may not use the Product for any purpose that is unlawful or prohibited by these Terms.

3. Ownership

The Product and all related intellectual property rights are owned by Nested, LLC or its licensors. You do not acquire any ownership rights in the Product by purchasing, downloading, or using it.

4. Restrictions

You agree not to:
a. Duplicate, replicate, or otherwise copy the home plans or files.
b. Use the plan for more than one (1) construction project. A separate license must be purchased for each additional build.
c. Hold us accountable for any communications before or after the purchase of the plans.
d. Copy, modify, distribute, or create derivative works based on the Product, unless you have purchased the BIM or CAD package. If you do, you may create modified works only for your personal use or to share with project contractors/subcontractors in PDF format. Modified works may not be sold, licensed, or used commercially.
e. Sell, rent, lease, or sublicense the Product.
f. Reverse engineer, decompile, or disassemble the Product except as needed for construction.
g. Remove or alter any copyright, trademark, or proprietary notices in the Product.

You understand that:
a. These plans do not include mechanical, electrical, plumbing, civil, or structural engineering drawings. Local authorities and consultants must be consulted to meet local requirements.
b. We may assist in coordinating additional services at our discretion, but are not obligated to do so.
c. We do not warranty the completeness, accuracy, or suitability of the plans, and are not required to provide further materials beyond what is provided at checkout.

5. Construction Cost Estimates & Plan Swap Policy

Nested Home Plans provides estimated construction pricing as a courtesy based on regional average cost-per-square-foot data. These estimates are non-binding and are for informational purposes only.

Construction costs may vary due to builder availability, site access, regional labor and material conditions, and other economic factors. By using our estimates, you agree to release and indemnify Nested, LLC from any claims, inaccuracies, or financial loss resulting from their use.

It is solely the homeowner’s responsibility to work with local builders to determine whether a plan is feasible within their budget.

Plan Swap Policy

If your builder determines that the plan you purchased exceeds your budget, you may request a one-time complimentary plan swap, subject to the following:

  • You must contact Nested, LLC to request the swap.
  • You must agree to delete and destroy all copies (digital and printed) of the original plan.
  • The license for the original plan will be terminated, and a new license will be issued for the replacement plan.
  • The replacement plan is subject to these Terms.
  • Only one swap per customer is permitted.

6. Payment and Refunds

All purchases are final. Refunds are not provided for digital products unless required by law or in the event of a technical issue we cannot resolve.

7. Support and Updates

We may offer updates or customer support at our discretion. Updates provided will be governed by these Terms.

8. Termination

We may terminate or revoke your license to access or use the Product at any time if you violate these Terms or misuse the Product.

Upon termination or revocation:

  • You must immediately stop using the Product.
  • You must delete or destroy all digital and printed copies.
  • All rights under the license will be forfeited.

Nested, LLC may revoke access without notice if there is any misuse that threatens our intellectual property or business operations.

9. Communication Disclaimer

By purchasing or downloading our Product, you consent to communication from Nested, LLC via phone, email, or other electronic methods for support, service updates, or follow-ups regarding your purchase.

You understand and agree that:

  • All communications are informal and non-binding.
  • Phone calls, emails, or other messages do not constitute legal advice, warranties, or modifications to these Terms unless stated in a signed agreement.
  • Communications may not be recorded or used in legal claims or proceedings, except where required by law.
  • We may retain internal records of communication for quality control or support purposes.

10. Licensed Architects & Indemnification

Some plans and products available through Nested Home Plans may have been originally created by licensed architects. In such cases, the architects are not providing architectural services to you directly. Instead, they are licensing their pre-designed drawings to Nested, LLC for resale.

By purchasing or using these products, you understand and agree that:

  • The architects involved are not providing professional architectural services to you.
  • The architects make no warranties or representations about the suitability of the plans for your specific site, region, or regulatory conditions.
  • You shall not hold the architects liable for any claims, disputes, damages, or losses related to your use of the Product.
  • You agree to indemnify, defend, and hold harmless any contributing architects from any claims arising out of your use of the Product, including but not limited to design suitability, permitting issues, or construction outcomes.

11. Disclaimer of Warranties

The Product is provided "as is" without warranties of any kind. We do not warrant that the Product will meet your specific requirements or be error-free.

12. Limitation of Liability

To the maximum extent allowed by law, Nested, LLC, its licensors, partners, and affiliates are not liable for indirect, incidental, or consequential damages arising from your use of the Product.

13. Indemnification

You agree to indemnify and hold harmless Nested, LLC and its affiliates from any claims, losses, damages, and legal fees resulting from your use of the Product or violation of these Terms.

14. Changes to Terms

We may update these Terms at any time. Continued use of the Product after changes constitutes acceptance of the revised Terms.

15. Governing Law

These Terms are governed by the laws of Washington State. Any disputes will be resolved exclusively in the courts of Washington State, USA.

17. Entire Agreement

These Terms constitute the entire agreement between you and Nested, LLC regarding the use of the Product and supersede all prior agreements.
